Child Custody and Parenting Plan Lawyers | Vacaville
Determining "the best interests of the children"
For a long time in California, the standard for determining child custody has been "the best interests of the children." It is state policy for children whose parents are separated or divorced to have regular and consistent contact with both of their parents. Often, however, the intended balance can be difficult to achieve.
For example, sharing physical custody on a day-by-day basis is virtually impossible for someone who leaves home every day at 4 a.m. to commute to work in San Francisco and comes home late at night. Joint physical custody is also challenging in the case of infants who are still nursing; generally speaking, they stay with their mothers.

Misconceptions about Custody and Visitation
In addition to worrying about the logistics of shared parenting, many divorcing parents have misconceptions about custody and visitation. Many fathers, for example, still think mothers automatically get sole custody and alimony. Likewise, some fathers think that by sharing custody they will be relieved of their obligation to pay child and spousal support. Both assumptions are wrong.
At Hubbard, Unger & Urquhart, we believe education is the most important part of family law. We counsel our clients so that they are fully aware of their rights and responsibilities under California law. Then we help them to sort through and weigh their options. Sometimes this involves enlisting the services of a marriage and family therapist, a child psychologist or other counselor. Sometimes, we advise our clients to seek anger management therapy. Always, we encourage our clients to consider the long-term consequences of their actions and, in so doing, to be mindful of the best interests of their children.
