It enables them to retain control of the process, avoid unwelcome and costly surprises and, generally speaking, ensures a better settlement agreement than one imposed by a court.
Child Support
Child support in California is determined by state formula. Additional factors may be considered, including special medical or educational needs of the children, sources of income in addition to earnings, and the capacity of the parents to work in order to contribute to the support of the children.
Spousal Support
Either spouse can be required to pay spousal support. The factors taken into consideration for spousal maintenance include the length of the marriage, the marital standard of living, the earning capacity of the spouse receiving support, the age and health of the parties, marital assets and debts, and evidence of domestic violence, if any, in the marriage.
When One Home Becomes Two
Marital settlements can be high and hurtful to the payer when they go strictly by the books. And, of course, maintaining the marital standard of income is impossible when one home becomes two, except for the very wealthy.
