Domestic Violence

Domestic Violence and Spousal Abuse Lawyers | Vacaville

Domestic violence is a very sensitive area of family law, and an increasingly common and unfortunate reality in our society, with consequences that can be devastating to both its adult and child victims. For one thing, it has a crucial impact on child custody. Also, in California you cannot be deported if you are a victim of domestic violence. So, sometimes, an accuser initiates a criminal action to circumvent deportation, but then discovers that a domestic violence complaint cannot be withdrawn.

At the law office of Hubbard, Unger & Urquhart in Vacaville, California, we offer representation to men and women in matters involving domestic assault. In these matters, as in all our practice areas, we are committed to making sure that the rights of all persons are respected and protected.

Domestic violence as a social and legal issue came out of the closet in the 1970s. In the decades since, domestic violence has gained wide recognition as a heinous form of criminal behavior that is perpetrated by one person in an intimate relationship to dominate and control his or her partner.

In recent years, however, a number of studies have described patterns of domestic violence that are more situational in nature. "Situational couple violence" is one such pattern. It has been described by Penn State sociologist Michael Johnson as the sort of violence that occurs "when a disagreement that turns into an angry argument escalates into violence." Women are as likely as men to be the perpetrators of such violence, according to Johnson, although men tend to do more serious damage.

"Intimate terrorism," according to Johnson, is much less frequent than situational couple violence. However, it is more likely to be fatal.

Johnson describes "violent resistance" as the type of domestic violence that occurs when a victim strikes back in self-defense at his or her abusive partner.
