Guardianship and conservatorship arrangements are similar in nature. The main difference between them is that a guardianship is for a child under the age of 18 and a conservatorship is for an adult.
The purpose of both is to designate responsibility for the care and well-being of individuals who are too young or otherwise unable to be legally responsible for themselves.
Guardians are appointed for minor children in situations where their parent or parents are unable to fulfill their parental responsibilities, because they are absent, unfit, terminally ill or deceased. The responsibilities of guardians include decision-making authority for living arrangements, education, medical care and financial management.
Courts appoint conservators to manage the affairs of adults who are unable to manage their own affairs because they have a mental disability or they have been incapacitated — for example, as the result of a serious accident or illness.
